INFORMATION ABOUT LISTING OF UNIT SUBSCRIPTION RIGHTS OF AB SHARES

The Management Board of the company under the name Polenergia S.A. (the “Company“) informs that on September 20, 2023 it became aware of:

The adoption by the Board of the Warsaw Stock Exchange S.A. (the “WSE“) (the “WSE Board“) on September 19, 2023, Resolution No. 977/2023 on the admission and introduction to exchange trading on the WSE’s Main Market of subscription rights to series AB ordinary bearer shares of the Company, pursuant to which the WSE Board:

1. a) stated that up to 66,802,246 pre-emptive rights to series AB ordinary bearer shares of the Company (the “Pre-emptive Rights“) will be admitted to exchange trading on the main market as of September 21, 2023, provided that the Krajowy Depozyt Papierów Wartościowych S.A. registers the Pre-emptive Rights and designates them with the code “PLPLSEP00138” no later than September 21, 2023 (the “Registration“);
2. b) decided to introduce, as of September 21, 2023, up to 66,802,246 Pre-emptive Rights to exchange trading on the main market, subject to Registration; and
3. c) decided to list the Pre-emptive Rights from September 21, 2023 to September 25, 2023 (inclusive) in the continuous trading system under the abbreviated name “PEP-PP” and the designation “PEPP.”
