INFORMATION ON THE LISTING OF RIGHTS TO SERIES AB ORDINARY BEARER SHARES

The Management Board of the company under the name Polenergia S.A. (the” Company”) informs that on October 31, 2023, it received information about the adoption by the Management Board of the Warsaw Stock Exchange (the “WSE Management Board”), on October 30, 2023, of resolution No. 1168/ 2023 regarding the admission and introduction to stock exchange trading on the WSE Main Floor of rights to series AB ordinary bearer shares of the Company (WSE Resolution), pursuant to which the WSE Management Board:

• stated that 10,416,667 rights to series AB ordinary bearer shares of the Company (“PDA”) are admitted for stock exchange trading on the main floor, on the date of registration by the National Depository for Securities Krajowy Depozyt Papierów Wartościowych S.A. (“KDPW”);
• decided to introduce 10,416,667 PDA to stock exchange trading on the main floor as of November 3, 2023, provided that KDPW registers these PDA on November 3, 2023 at the latest and marks them with the code “PLPLSEP00153”; and
• decided to list the PDA referred to in point 2) in the continuous listing system under the abbreviated name “PEP-PDA” and the symbol “PEPA”.

With reference to the Company’s current report No. 45/2023 of October 26, 2023, the Company’s Management Board also informs that the adoption of the WSE Management Board of the WSE Resolution constitutes at the same time the fulfillment of the condition for registration of the PDA in the securities depository by KDPW as desceribed in the a/m current report of the Company.
