Submission of amendments to claims by subsidiaries of Polenergia S.A. – Amon Sp. z o. o. and Talia Sp. z o. o. against Tauron Polska Energia S.A.

The Management Board of the company under the name Polenergia S.A. (“Issuer”), with reference to the Issuer’s current reports No. 12/2018 of May 1, 2018 and No. 35/2020 of December 29, 2020, informs that on December 28, 2023, the Issuer’s subsidiaries – Amon Sp. z o. o. based in Łebcz (“Amon”) and Talia Sp. z o.o. with its registered office in Łebcz (“Talia”) filed a second amendment to the claims against Tauron Polska Energia S.A. (“Tauron”) to the District Court in Katowice, 14th Commercial Division. This amendment covers the compensation claims of Amon and Talia arising after June 30, 2020.

The basis for Tauron’s tortious liability for damages is the severance and cessation of performance by Polska Energia – Pierwsza Kompania Handlowa Sp. z o.o. – a subsidiary of Tauron, long-term contracts for the sale of electricity generated from renewable sources and long-term contracts for the sale of property rights resulting from certificates of origin confirming the production of electricity from renewable sources concluded with Amon and Talia.

Pursuant to the modification in question, the claims for compensation with interest increased – in the case of Amon by the amount of PLN 29,668,791.42, in the case of Talia by the amount of PLN 19,277,206.14.
