Submission of changes to claims by subsidiaries of Polenergia S.A. – Amon Sp. z o. o. and Talia Sp. z o. o. against Polska Energia – Pierwsza Kompania Handlowa Sp. z o. o.

The Management Board of the company under the name Polenergia S.A. (“Issuer”), with reference to the Issuer’s current reports No. 14/2015 of March 23, 2015, No. 24/2019 of July 25, 2019, No. 27/2019 of August 21, 2019, No. 54/2021 of December 29, 2021 and No. 34/2022 of November 17, 2022, informs that on December 28, 2023, the Issuer’s subsidiary – Amon Sp. z o. o. with its registered office in Łebcz (“Amon”) filed a second amendment to the claim against the subsidiary of Tauron Polska Energia S.A. – Polska Energia-Pierwsza Kompania Handlowa Sp. z o. o. with its registered office in Warsaw (“PKH”) to the District Court in Gdańsk, 9th Commercial Division, in connection with the ineffective termination and non-performance by PKH of long-term energy sales contracts and property rights concluded by PKH with Amon. Pursuant to the above amendment claim, Amon, in addition to the amounts claimed so far, demands payment of PLN 18,297,696.66 as compensation for failure to perform the above-mentioned contracts during their further period of validity.

Moreover, the Issuer’s Management Board, in reference to the Issuer’s current reports No. 14/2015 of March 23, 2015, No. 27/2019 of August 21, 2019, No. 6/2020 of March 6, 2020, No. 21/2020 of August 8 September 2020, No. 48/2021 of December 20, 2021 and No. 54/2021 of December 29, 2021, informs that on December 28, 2023, the Issuer’s subsidiary – Talia Sp. z o.o. with its registered office in Łebcz (“Talia”) filed a fifth amendment to the claim against PKH to the District Court in Gdańsk, 9th Commercial Division, in connection with the ineffective termination and non-performance by PKH of long-term contracts for the sale of energy and property rights concluded by PKH with Talia. Pursuant to the above amendment claim, Talia, in addition to the amounts claimed so far, demands payment of PLN 12,075,080.14 as compensation for failure to perform the above-mentioned contracts during their further period of validity.
